Huh. Well this just opens up a whole can of worms, doesn’t it? Sexy, mentally handicapped worms. A High Court judge ruled that ‘Alan,’ who’d been in a relationship with another fellow, lacks “the capacity to consent to and engage in sexual relations.”
Until the ruling was made, ‘Alan,’ 41, lived with his partner in a council home; he will now be ‘closely supervised’ to ensure that he does not break the ban. Presumably somebody will be standing outside with a bottle of Windex, ready to jump into action if needs be.
The crux of the ruling seems to hinge on the Mental Capacity Act of 2005 – given the low I.Q displayed by Alan, judges have the power to make certain decisions for those deemed incapable or unfit to make them for themselves; the rationale, then, is that the mentally handicapped man is being prevented from having sex, which he evidently enjoys, because it is ‘for his own good.’ The nanny state then burped the members of the jury, and tucked them all into bed.
