    What started as a bargain may have turned into a case of near bankruptcy for a 23-year-old Swiss baker, who recently had a head-on collision with a BMW in a limited edition Ferrari 360 Spider F1 Challenge Stradale. He is now looking at having to fork out approximately R3,4 million to repair the damaged supercar.

    Sebastian Vogel thought that he had bought himself the deal of a lifetime when he bought a coupon on Groupon-style site, YourDeal. Paying a mere R350 for a spin in a Ferrari, his ride lasted little over 15 minutes before it all went wrong. The collision with a BMW happened on a country lane in Bern, Switzerland, destroying the front of the Beemer and badly damaging the Ferrari. Both drivers survived the collision.

    Vogel of course had full insurance for the ride – this is Switzerland, after all – but a little bit of fine print is going to force him to foot the bill himself. Whilst the policy covers all manner of damage, a little proviso says that all claims will be void if the driver was speeding. Police are now looking at the Ferrari’s on-board GPS and engine management system to try and determine at what speed the collision happened.

    The 360 F1 Challenge Stradale is the fastest road-legal version of the 360, topping out at 305 km/h.

      thats not a challenge stradale. Its a spyder. The stradale has a hard top. Theyll also have to prove that the cars ecu was correctly calibrated. Oh, and there is no “Onboard GPS”. Storm in a tea cup.

      It seems odd that he is liable for the damage when he paid to have a joyride. If I have a spin on a carnival attraction and it breaks, that’s not my problem. This really does not add up and I suspect that he won’t have to foot any bill, other perhaps for a lawyer to write a nice letter to the folks who rented out the car.

      There is a big difference between a rental and a joyride. On the latter the company assumes liability and pays insurance in accordance to how the car will be used. I’d bet that it would also stipulate that a representative has to be present, especially when you hand over the keys of a limited-edition sports car to a 23-year old.

      On top of that, few people have an insurance package that automatically covers them to drive any multi-million rand car. The story just doesn’t add up.

      There’s actually not much difference at all. Whether it’s ‘use and enjoyment’ for one year, one month, one day, one hour or one minute; it’s still use and enjoyment. Liability can be passed to the client.

      If you, James Francis, had to rent a luxury vehicle from Avis, you would be responsible for up to R300k if the car was stolen / written off under your care. This would be over and above the insurance that you would have already paid for as part of the rental cost.

      Except that this is not a rental situation. He did not rent the car. He paid for a joyride in it. Might sound the same, but there is a huge distinction – at the least as far as insurance is concerned. If you go to Avis and rent a Ferrari, you will pay a very different amount and sign different papers as if you went to Kyalami and paid to take it around the track.

      This story sounds like rubbish to me. What can the owners do to a 23 year old? Sue him and attach his assets (of which there would be none at age 23)? He can file for bankruptcy and won’t be able to borrow for 5 years and thereafter life’s back to normal. There’s no prison time for owing money either. If he doesn’t have it, he doesn’t have it. But still this story doesn’t make sense at all, and shouldn’t have been allowed to go to press in the first place. No sane businessperson would rent out a milti-million rand limited edition supercar to a twentysomething on a discount coupon for 350 ZAR. The Swiss may be neutral, but their definately not idiots. I doubt the insurance on this car is less than 350ZAR. Don’t even get me started on supervision for the youngster. 2OV.com must get their facts straight before they publish such nonsense.
